Sometimes during the course of the administration of a probate estate conflicts arise. In some cases those conflicts be resolved without litigation, by discussions between the parties and their attorney where they can reach agreement or through mediation between the parties with an estate administration mediator.
If the conflict cannot be resolved by agreement or mediation probate litigation may be necessary to insure that the wishes of the deceased person are honored. I have represented numerous clients in trust and estate related litigation, including trust litigation, trust management disputes, estate and probate litigation, and will contests.
In some cases I represent the person who has been appointed the personal representative of the estate who needs to instigate litigation or defend against estate litigation. In other cases I represent family members or other interested persons (as defined by Maryland law) who disagree with some aspect of the administration. Other cases involve me representing someone who is contesting the validity of a Will (called a “caveat proceeding”). I have represented trust beneficiaries who have some disagreement with the administration of the trust.
